German Constitutional Court Rules Mass Cancellation of Afghan Admission Commitments Unconstitutional — Pajhwok

KABUL (Pajhwok): Germany’s Constitutional Court has ruled that the government cannot collectively revoke commitments to admit Afghan migrants and that each case must be assessed individually, according to reports. The court announced on Friday that the blanket cancellation of government commitments to admit Afghan citizens was inconsistent with the country’s constitution and that German authorities were required to examine each case separately. The ruling followed a complaint filed by an Afghan woman and her two children. The family had been selected for relocation to Germany in 2021 under the previous German government’s humanitarian admission programme, following the Islamic Emirate’s return to power. Reuters reported that the court found the German Interior Ministry’s December 2025 decision to revoke around 640 admission commitments without examining each individual case violated the principle prohibiting arbitrary government action. According to the ruling, once the government has made an admission commitment to an individual, any change to that decision must take the person’s specific circumstances into account. The court ordered the family’s case to be reconsidered by the competent administrative court. It also said the German government must continue supporting the family, currently living in Pakistan, until visas are issued or another constitutionally compliant decision is made. Germany’s Interior Ministry has not yet commented on the ruling.
